David: I read over the opinion this morning…an open door…mmmmm…maybe by virtue of the last slam of the door not quite catching! And, as you say, the fact that they wrote an opinion at all. Will look forward to hearing more of your thoughts about it tomorrow. Jen
Jen: This letter is the opinion of the court in the CEB case concerning the cages. I have left a copy for you on the kitchen table.
Though the opinion affirms the CEB decision, it is at least an opinion. Receiving more than a perfunctory affirmation is a victory of sorts because, as you know, the court can make its decision without issuing an opinion, without giving any explanation. So, I’m pleased the court wrote an opinion – it provides a solid basis for a petition to the District Court of Appeals. David
